Desaign, service and trade craft

1. Introduction and Company Details

These Terms of Service (hereinafter: "Terms") govern the rights and obligations of users and customers when using the website and services of Desaign, service and trade craft, owner Filip Đurkan (hereinafter: "Craft"). By using the website and registering an account, the user is considered to have fully read, understood, and accepted these Terms. These Terms are drafted in accordance with the applicable regulations of the Republic of Croatia.

2. Definitions

  • Craft: Desaign, service and trade craft, owner Filip Đurkan.
  • Website: Internet page of the Craft through which products are ordered.
  • User/Customer: Natural or legal person accessing the website or making a purchase.
  • Product: Physical T-shirt or hoodie with a personalized design created using artificial intelligence (AI).
  • Service: Enabling users to generate designs via AI tools and subsequent production/delivery of Products.

3. User Account

Access to services requires account registration via Google login or email/password. The user warrants for the accuracy of entered data and is responsible for account security. The Craft reserves the right to suspend accounts for violating these Terms. Services are intended for persons over 18.

4. Service Description and Orders

The Craft provides a platform for generating visual designs using OpenAI and ordering personalized products. Order process:

  1. User creates a design via AI tool.
  2. User selects Product, size, and specifications and orders.
  3. Payment is made via Stripe.
  4. After confirmation, the order is forwarded to Gelato for printing and shipping.

The Craft acts as a technical intermediary and exercises no editorial control over designs.

5. Prices and Payment

Prices are clearly displayed. The Craft is currently not in the VAT system.

  • Payment is made exclusively in advance via Stripe (cards, Google Pay, Apple Pay).
  • Payment security is ensured by Stripe; the Craft does not store card data.

6. Delivery

Delivery is performed by partner Gelato.

  • Estimated delivery time is approx. 5 working days, but may vary.
  • Shipping costs are displayed at checkout.
  • For international deliveries (non-EU), the Customer bears customs costs.

7. Right to Terminate and Returns

Cancellation:

Customer can cancel the order within 1 hour of payment OR before the order enters production. After that, cancellation is not possible as these are personalized products (Consumer Protection Act).

Complaints:

Returns are only possible for damaged products or obvious print errors. Complaints must be sent to info@desaign.store within 7 days with a photo.

Note: Color differences (RGB vs CMYK) or 'AI hallucinations' approved by the customer are not grounds for a complaint.

8. User Content and Liability

User retains copyright on their design but grants the Craft a license to fulfill the order. User warrants content:

  • Does not infringe third-party rights (copyright, trademark).
  • Does not use celebrity likenesses without consent.
  • Does not contain illegal or offensive content (zero tolerance for child sexualization).

9. Governing Law

These Terms are interpreted in accordance with the law of the Republic of Croatia. Disputes are subject to the jurisdiction of the court in Zagreb.
